To register or for more information on Foundation seminars, programs and publications, call 1-800-FREE-LAW.  The Foundation&#8217;s seminar series is made possible by funding from the IOLTA Fund of the Bar of New Jersey.The New Jersey State Bar Foundation will present a free public seminar on navigating through the <strong>&#8220;Medicare-Medicaid Maze&#8221;</strong> on <strong>Thursday, February 19, from 1 to 3 p.m</strong>. at the New Jersey Law Center, One Constitution Square off Ryders Lane in New Brunswick.</p>
<p>Marilyn Askin, J.D., chief legislative advocate for AARP-New Jersey, and Linda S. Ershow-Levenberg, a partner with the Clark law firm of Fink Rosner Ershow-Levenberg, LLC, will serve as speakers. The program will feature an explanation and update of Medicare, a federal program of health insurance, Medicaid and New Jersey programs designed to provide health care coverage to the poor, the disabled and the elderly. Planning for long-term care insurance also will be covered. A question-and-answer period will follow.</p>
<p>Askin is the founder and past chair of the New Jersey State Bar Association&#8217;s Aging and the Law Committee, now the Elder and Disability Law Section, which presented her with a Lifetime Achievement Award last June. She served as director of the Senior Citizens Legal Services of Essex County for more than 15 years and currently teaches elder law seminars at Rutgers Law School-Newark. Appointed by Gov. Corzine to the Health Care Access Study Commission, she stepped down as president of the New Jersey Women Lawyers Association to become president of the AARP-New Jersey.  Having completed her term, Askin recently received that organization&#8217;s most prestigious volunteer award, the Andrus Award for Community Service.  She maintains homes in West Orange and Monroe Township.</p>
<p>Ershow-Levenberg is a certified elder law attorney, chairman of the New Jersey State Bar Association&#8217;s Elder and Disability Law Section, member of the National Academy of Elder Law Attorneys and past chairman of the Union County Bar Association&#8217;s Elder Law Committee.   The co-author of the<em>Lexis-Nexis Practice Guide: NJ Elder Law</em>, she argued before the N.J. Supreme Court concerning <em>In re Keri</em>, a seminal case concerning Medicaid planning by guardians. Ershow-Levenberg&#8217;s practice concentrates in elder law, including Social Security disability appeals, Medicaid applications and estate planning and administration.</p>

<div><span style="line-height: 24px; font-size: large;">This bill establishes an exception to the five-year limitation on payments of claims to victims by the <a title="Victims of Violent crimes compensation office" href="http://www.garcesgrabler.com/Our_Services/Victims_of_Crime_Compensation_Board.php" target="_blank">Victims of Crime Compensation Office</a>.</span></div>

<div><span style="line-height: 24px; font-size: large;">Under current <a title="Law" href="http://www.garcesgrabler.com//Glossary/L.php#Legal" target="_blank">law</a>, a victim’s <a title="Claim" href="http://www.garcesgrabler.com/Glossary/C.php#Claim" target="_blank">claim</a> for compensation expires five years after an initial determination order is made by the <a title="Victims of violent crimes compensation office" href="http://www.nj.gov/oag/njvictims/" target="_blank">Victims of Crime Compensation Office.</a> This bill would allow the office to continue making payments to a victim if the office determines that compelling circumstances exist justifying the payment of a claim beyond the five-year limit.</span></div>
<div><span style="line-height: 24px; font-size: large;"><br />
</span></div>
<div><span style="line-height: 24px; font-size: large;">According to the sponsor, this bill is needed to assist victims who have legitimate reasons to require services beyond five years.  For example, a victim who received mental health counseling during an initial <a title="Trial" href="http://www.garcesgrabler.com/Glossary/T.php#Trial" target="_blank">trial</a> against the defendant was denied further counseling during a retrial because the new trial occurred more than five years after the victim received counseling during the first trial.  Under this bill, the office would have discretion to award payments beyond the five-year limitation in such cases.</span></div>

			<content:encoded><![CDATA[<p>As we all know the  holiday season is upon us and as much as this is a festive time of year it&#8217;s good to remember safe driving; as unfortunately it is also the most dangerous time of year to be on the roads. The Thanksgiving weekend marks the beginning of the holiday season. As it turns out many of you will be traveling this Thanksgiving holiday. Since Thanksgiving is one of the most traveled American holidays, I feel it&#8217;s a good time for travel tips and facts.</p>
<ul>
<li>The number of people traveling over Thanksgiving is second only to the year-end holidays, according to AAA.</li>
<li>More than 80 percent will travel by car</li>
</ul>
<p><strong>BE SURE TO PLAN AHEAD. ALLOW YOURSELF EXTRA TIME.</strong></p>
<ul>
<li>Concentrate. Stay focused as to not become distracted by talking on your cellular phone, eating, drinking or putting on makeup.</li>
<li>Relax. Tune the radio to your favorite relaxing music. Music can calm your nerves and help you to enjoy your time in the car.</li>
<li>Drive the Posted Speed Limit. Fewer crashes occur when vehicles are travelling at or about the same speed.</li>
<li>Identify Alternate Routes. Try mapping out an alternate route. Even if it looks longer on paper, you may find it is less congested.</li>
<li>Use Public Transportation. Public transportation can give you some much-needed relief from life behind the wheel.</li>
<li>Or just be late. If all else fails, just be late. Remember, your friends and relatives would rather see you arrive safely and late then drive unsafely or be involved in a <a title="Motor Vehicle Accidents" href="http://www.garcesgrabler.com/Our_Services/Auto_Accidents.php" target="_blank">motor vehicle accident</a>.</li>
</ul>
<p><strong>AVOID AGGRESSIVE DRIVERS</strong></p>
<ul>
<li>If confronted by an aggressive driver, do your best to get out of their way as soon as possible.</li>
<li>Avoid any confrontation or challenge.</li>
<li>Be willing to let them pass you when possible.</li>
<li>Avoid eye contact and by all means ignore gestures and refuse to return them.</li>
<li>If aggressive driving becomes a problem pull over to a safe place and call the police.</li>
</ul>
