Marilyn Askin, J.D., chief legislative advocate for AARP-New Jersey, and Linda S. Ershow-Levenberg, a partner with the Clark law firm of Fink Rosner Ershow-Levenberg, LLC, will serve as speakers. The program will feature an explanation and update of Medicare, a federal program of health insurance, Medicaid and New Jersey programs designed to provide health care coverage to the poor, the disabled and the elderly. Planning for long-term care insurance also will be covered. A question-and-answer period will follow.

Askin is the founder and past chair of the New Jersey State Bar Association’s Aging and the Law Committee, now the Elder and Disability Law Section, which presented her with a Lifetime Achievement Award last June. She served as director of the Senior Citizens Legal Services of Essex County for more than 15 years and currently teaches elder law seminars at Rutgers Law School-Newark. Appointed by Gov. Corzine to the Health Care Access Study Commission, she stepped down as president of the New Jersey Women Lawyers Association to become president of the AARP-New Jersey.  Having completed her term, Askin recently received that organization’s most prestigious volunteer award, the Andrus Award for Community Service.  She maintains homes in West Orange and Monroe Township.

Ershow-Levenberg is a certified elder law attorney, chairman of the New Jersey State Bar Association’s Elder and Disability Law Section, member of the National Academy of Elder Law Attorneys and past chairman of the Union County Bar Association’s Elder Law Committee.   The co-author of theLexis-Nexis Practice Guide: NJ Elder Law, she argued before the N.J. Supreme Court concerning In re Keri, a seminal case concerning Medicaid planning by guardians. Highest verdict for a verbal case in Mercer County against GEICO

Congratulations to New Jersey personal injury attorney Kevin S. Riechelson, Esq. of Garces & Grabler, P.C. on his remarkable recovery in a matter that was just heard at trial before the Honorable Paul Innes, J.S.C. in Mercer County New Jersey that resulted in a verdict of $80,000.00. Although it doesn’t seem like a large amount, this was a verbal threshold case with a three-month delay in treatment and 5 months of chiropractic care and one orthopedic visit. New Bill to Victims by the Victims of Crime Compensation Office

The Senate Law and Public Safety Committee reports favorably Assembly Bill No. 2372.

This bill establishes an exception to the five-year limitation on payments of claims to victims by the Victims of Crime Compensation Office.

Under current law, a victim’s claim for compensation expires five years after an initial determination order is made by the Victims of Crime Compensation Office. This bill would allow the office to continue making payments to a victim if the office determines that compelling circumstances exist justifying the payment of a claim beyond the five-year limit.

According to the sponsor, this bill is needed to assist victims who have legitimate reasons to require services beyond five years.  For example, a victim who received mental health counseling during an initial trial against the defendant was denied further counseling during a retrial because the new trial occurred more than five years after the victim received counseling during the first trial.  Under this bill, the office would have discretion to award payments beyond the five-year limitation in such cases.

As reported by the committee, this bill is identical to Senate Bill No.1893, which also was reported by the committee on this date.

New Driving Laws in New Jersey

Snow covered car New JerseyWith the start of winter just around the corner, the law offices of Garces & Grabler, P.C. would like to remind New Jersey motorists of the new ameded law that went into effect on October 20, 2010.

The new law requires that all motorists in the State of New Jersey remove all snow from exposed areas of their vehicle prior to driving on New Jersey roads. Failure to remove the snow and ice from your vehicle may result in a fine or citation.

Before the change in the law motorists in New Jersey could only be fined or cited if property damage or injury occurred due to failure to remove ice and snow from the vehicle.

Be sure to be safe and courteous to other drivers. Remove snow and ice from your vehicle prior to driving especially on the hood of the car, roof or trunk. The sheets of snow and ice can become deadly projectiles as you drive on the road. Also be sure that all your lights and windows are clear of ice and snow. Remember these safety precautions can be crucial to your safety and the safety of other drivers, as well as save you from a driving ticket in New Jersey.

The law offices of Garces & Grabler, P.C. recommend that you plan ahead to take time to clean all snow and ice off your vehicle before driving. After all, it could save a life to do so as well as avoid a fine, as New Jersey Troopers will be enforcing the new law this year. Fines for violating the new law range from $25 to $75. No motor vehicle points will be assessed for this offense. If failure to remove ice and snow results in injury or property damage, motorists face fines ranging from $200 to $1000, while commercial motor vehicle drivers face fines ranging from $500 to $1,500, for each offense.

In anticipation of the inclement weather, New Jersey motorists are encouraged to:

  • Tune up and winterize their vehicles, as well as check the radiator, battery, antifreeze, and all other fluid levels.
  • Check tire treads and replace the tires if they’re unsafe.
  • Check and replace windshield wiper blades if the rubber is cracked and/or brittle, and be sure to check and refill the washer fluid reservoir.
  • Maintain at least a half a tank of gas during the winter to prevent the fuel line from freezing.

Motorists should also start assembling their winter driving “safety kit” before the onset of inclement weather. The kit should include:

  • an ice scraper/brush; shovel; jumper cables or battery starter;
  • warm blanket;
  • sand, salt or cat litter (for traction in ice and snow);
  • de-icer;
  • safety flares/warning devices;
  • flashlight and new batteries;
  • extra windshield washer fluid;
  • cell phone with a charged spare battery;
  • water and non-perishable food (i.e. granola or protein bars);
  • and, paper towels or a cloth.
